What a Mountain Summit Financial loan cost

Mountain Summit lent alongside Golden Valley, Silver Cloud and Majestic Lake, at the same rates: the CFPB put the four brands at 440% to 950% APR on loans of $300 to $1,200.

At those rates a $500 loan run to term costs multiples of the principal, and the finance charge overtakes the amount borrowed within months. That is the ordinary arithmetic of this sector and it is not what makes Mountain Summit different.

What makes it different is the date. A borrower who took an identical loan from Silver Cloud in March 2021 owes nothing today. A borrower who took it from Mountain Summit in March 2021 may owe the full balance plus everything that has accrued since.

Same tribe, same operator, same rate, same month — different outcome, decided by a line in a settlement agreement.

The cut-off, and what to do if you are on the wrong side of it

The Hengle v. Asner settlement (E.D. Va. 3:19-cv-00250) received final approval on 25 October 2022, cancelling over $450 million of debt across the four Habematolel Pomo of Upper Lake brands for roughly 555,000 borrowers, plus a $39 million cash fund. Relief was automatic.

Cancellation reaches Golden Valley, Silver Cloud and Majestic Lake loans taken at any time. For Mountain Summit, it reaches only loans taken before 1 February 2021.

If your loan falls after that date, the settlement is not your route. Your state is. In nine states, loans above the rate cap are void outright — nothing is owed regardless of what any contract or settlement says. That question is decided by where you lived when you borrowed, not by the class action.

Beyond that: demand written validation from anyone collecting, request the full payment history and the original agreement, and revoke ACH authorisation in writing to both the collector and your bank. Do not make a payment to buy time — a payment can restart the limitation clock on a debt that may already be unenforceable.

Why you cannot look this up yourself

upperlakesettlement.com, the official administrator’s site, is now a blank placeholder. The class period is closed and the distribution is complete, so the site was decommissioned.

That is normal housekeeping, and it has an awkward consequence: the borrowers most likely to search for this brand today are the ones still being chased, and the one authoritative source that could tell them whether their loan was inside the window no longer exists.
