A federal appeals court threw out WithU Loans' arbitration clause in 2026 because it pointed to tribal law that did not yet exist — and the company claimed the right to invent it. That tells you how the structure works.

What a WithU Loans loan really costs

WithU lends $300 to $2,500 as a bi-weekly installment loan, one at a time — you repay, then reapply. It does not publish a fixed APR range; the rate 'varies' and is disclosed only in the agreement. Court filings put real disclosed rates at 498.63%, 497.25%, 476.18% and 569.64%. A sample schedule runs 26 bi-weekly payments, roughly a year.

The one way borrowers escape the cost is speed: there is no prepayment penalty, and people report borrowing $1,000 and repaying about $1,025 by paying off before the first scheduled bill. Two operational traps recur.

ACH debits can post a business day early around weekends and holidays, triggering overdrafts; and revoking payment authorization only sticks if you email a written 'Terminate EFT Authorization' request to [email protected] at least three business days ahead.

Where it's less bad
  • Same-day funding if you clear the wire/direct-deposit cutoffs.
  • No prepayment penalty — paying off before the first bill caps the cost.
  • One loan at a time, so you cannot stack balances.
What to watch
  • Effective APRs of roughly 476–597% documented in court filings.
  • Recurring identity-theft complaints — accounts opened using victims’ SSNs.
  • ACH debits can hit a business day early on weekends and holidays.
  • Three separate federal class actions across Illinois, Florida and Indiana.

Where WithU Loans lends

Per WithU's own FAQ it does not lend in these 11 states; it markets to roughly 39 others.

By its own terms, WithU Loans does not lend to residents of:

Does WithU Loans report to credit bureaus?

WithU does not report to the three major bureaus in a way that builds credit, and it approves using subprime alternative data (Clarity/DataX/Teletrack-type sources). On-time payments generally will not raise your score. It bars active-duty military (a Military Lending Act workaround) and anyone with a past or pending bankruptcy — unusually strict eligibility.

Who actually owns and runs WithU Loans

WithU is operated by W6LS, Inc., chartered under the Otoe-Missouria Tribe of Indians in Red Rock, Oklahoma, and regulated by the tribe's own Consumer Finance Services Regulatory Commission. A separate, non-tribal company — Caliber Financial Services — handles underwriting, funding and collections.

Litigation alleges the business is actually run primarily out of Kansas, using Oklahoma UPS-store mailboxes to project a tribal presence, with 'virtually none' of the operation on the reservation.

The 2026 arbitration ruling that matters

In Harris & Olds v. W6LS, Inc. & Caliber Financial (N.D. Ill., 1:23-cv-16429), borrowers charged 498.63% and 497.25% on $600 loans challenged WithU's arbitration clause.

On March 31, 2026 the Seventh Circuit affirmed that the clause was unenforceable — because it directed disputes to tribal law that did not yet exist and which the company asserted a unilateral right to create. Rehearing was denied June 5, 2026. Two more federal suits, Spigner (M.D. Fla.) and Pursley (S.D. Ind., alleging 569.64% against Indiana's 36% cap), remain active.

What WithU Loans costs in dollars

WithU Loans's published ceiling is 700% APR. Below is what that rate does to the amounts it actually lends, repaid over 12 monthly payments.

What $200–$2,500 costs at WithU Loans's 700% APR over 12 monthly payments
You borrowMonthlyTotal repaidInterest
$200$117$1,406$1,206
$1,400$820$9,840$8,440
$2,500$1,464$17,571$15,071

At 700%, a $200 balance accrues about $117 in interest every month. Any payment below that figure leaves you owing more than you started with, however long you pay.

Standard amortisation at the published ceiling rate; fees are not included, and your actual rate and term may differ. Run your own numbers in the payoff calculator.

Frequently asked questions

Is WithU Loans legit?

It is a real, operating tribal lender owned by the Otoe-Missouria Tribe, but it is expensive and heavily litigated: effective APRs run roughly 476–597%, and a 2026 federal appeals court voided its arbitration clause. Treat it as a last resort and read your agreement’s APR box before signing.

What is the real APR on a WithU loan?

WithU does not publish a fixed rate; court filings document real disclosed APRs of 476–597%. Your own loan agreement will state the exact figure — that is the number that matters.

How do I stop WithU from withdrawing money?

Email a written "Terminate EFT Authorization" request to [email protected] at least three business days before your next payment, including your name, address and loan number. You still owe the debt, but this revokes the automatic ACH pull. If debits continue, contact your bank to block them.

Why does WithU have identity-theft complaints?

The BBB and CFPB records show recurring reports of accounts opened using consumers’ Social Security numbers without their knowledge. If you find a WithU account you did not open, file identity-theft reports with the FTC and the credit bureaus and dispute it in writing.

Is WithU Loans a tribal loan?

Yes. WithU Loans is a tribal lending brand owned by the Otoe-Missouria Tribe in OK. That means it lends under tribal law and claims sovereign immunity from your state's interest-rate cap, rather than holding a state lending licence. It is also why its APR reaches 500–700% — far above the roughly 36% cap most states set for small loans. Whether the loan is enforceable where you live depends on your state.

What does a loan from WithU Loans cost?

WithU Loans lends $200–$2,500 at 500–700% APR. At those rates the total repaid is typically several times the amount borrowed, because interest is front-loaded — check the total of payments, not the monthly figure.

Is a loan from WithU Loans legal in my state?

It depends entirely on your state. High-cost tribal loans are effectively banned in nine states, where a loan above the rate cap can be void and not legally collectible, and restricted in many more. WithU Loans claims tribal sovereign immunity from those caps — an argument courts have accepted in some cases and rejected in others. Check your state before you borrow, and especially before you pay a collector.

How this site works

We are an independent registry — not a lender, not a broker and not a lead generator. This lender did not pay to appear here and cannot pay to change what the review says. We take no money from any lender and sell no applications.

Entries are built from the lender's own published disclosures, tribal corporate and lending-authority records, federal and state court filings, and CFPB, FTC and state regulator actions. Of the 143 brands in the full list of tribal lenders, 41 are confirmed lending, 74 sit on a watchlist pending verification, and 28 have shut down. Where a figure cannot be sourced we leave it blank rather than estimate it — which is why some entries are deliberately incomplete.
